High Court ruling - asylum seekers entitled to free NHS treatment

Asylum seekers refused leave to remain are entitled to free NHS care for as long as they stay in the UK, following a ruling in the High Court on 11 April by Mr Justice Mitting.

The judge ruled that that asylum seekers granted entry to the UK but declined leave to remain are in the UK legally and therefore count as "ordinary residents". NHS treatment is free to anyone who is an ordinary resident. Therefore all asylum seekers are entitled to free NHS treatment until they are removed from the UK.

The case was brought by a Palestinian asylum seeker denied free NHS care for chronic liver disease, and was supported by a number of charities, including the National AIDS Trust.
