Court grants NHS campaign group permission to appeal

Dear All,

Court of Appeal grants NHS campaign group permission to appeal against NHS England’s new Integrated Care Provider contract

There have been two judicial reviews on these Accountable Care Organisations and Integrated Care Provider (ACO/ICP) contracts. And the courts found in favour of the NHS. But one of the campaign groups, 999 Call for the NHS, has now been granted permission to appeal.

This is some very good news. But it also means NHS England is consulting on an ACO/ICP contract that may be unlawful.

NHS England knew full well that an appeal was a possibility. Although fully aware of this, on Friday 3rd August – the day Parliament and the Courts went on holiday – NHS England started a public consultation on the ACO/ICP contract. The consultation says that the Judicial Reviews had ruled in their favour. Their consultation runs until 26 Oct.

You can read more about this here: https://www.sochealth.co.uk/2018/08/19/appeal-against-nhs-englands-new-integrated-care-provider-contract-by-jenny/

All the best,
Roy
